The family of a Colorado tourist killed on Miami Beach faces a permanent loss, according to prosecutors, who have asked a judge to sentence the convicted killer to life in prison. The defense team has requested a maximum of 25 years.

The sentencing hearing for Tamarius Davis, 27, concluded on Wednesday after three days of testimony and argument. Davis admitted in early 2026 to second-degree murder in the 2021 shooting of Dustin Wakefield, who was 21 at the time.

The incident occurred in the 1400 block of Ocean Drive, where Wakefield was eating with his wife and 1-year-old son at La Cerveceria. Davis approached the table and pointed a gun at the infant. Wakefield begged for his child's life before being shot in front of his family.

Prosecutor Casey Hughes told the court that Davis fired five shots at Wakefield. Hughes argued that the Wakefield family has already received a life sentence through their grief. "The Wakefields have been forced to accept a life sentence," Hughes said. "They will mourn the loss of Dustin for the rest of their lives. Tamarius Blair Davis deserves that same life sentence."

The defense argued for leniency, noting that Davis consumed psychedelic mushrooms before the shooting and was unaware of his actions. Attorney Juan Mourin stated that the defense was not seeking an excuse for the crime. "No one is seeking in any way to excuse Blair for what he did," Mourin said. Mourin described Davis as remorseful and said the defendant privately expressed guilt.

Davis, wearing an orange jumpsuit and shackles, testified on Tuesday. He apologized to the family and said he would continue to pray for them. Wakefield's mother, Lora, spoke before the arguments ended. She said she had forgiven Davis on the first day of the hearing but wanted the world to see consequences for such choices. "It needs to stop. It needs to stop. Our children are being killed now," she said.

The judge indicated she has much to consider before issuing a decision. She is scheduled to read the sentence on Thursday morning.
